The respective voting rights notificationswere published separately by HAMBORNER AG today pursuant to section 26para. 1 WpHG.Based on information by the notifying entities, the notifications were madedue to the registration of a capital increase in HSH Nordbank AG, which wasregistered in the commercial register on 25 June 2009 and due to which thenotifying entities achieved a dominant position regarding HSH Nordbank AG.Furthermore, the notifying entities informed that they have simultaneouslyfiled an application for an exemption from the statutory duty to file amandatory offer to the shareholders of HAMBORNER AG with the FederalFinancial Supervisory Authority (Bundesanstalt fürFinanzdienstleistungsaufsicht, BaFin) pursuant to section 37 of the GermanSecurities Acquisition and Takeover Act (Wertpapiererswerbs- undÜbernahmegesetz, WpÜG) in connection with section 9 sentence 2 no. 3WpÜGOffer Regulation (WpÜG-Angebotsverordnung).HAMBORNER AG does not have any information on the status of the applicationfor an exemption.
